These Terms set out the rules for using the Website, placing Orders, making payments and transferring rights to internet Domain names offered by the Seller.
The Seller owns or controls the Domains offered on the Website and is entitled to transfer them to the Buyer.
Use of the Website requires a device with internet access and an up-to-date web browser.
§2. Definitions
Website – the GodOfBrands website available at godofbrands.com.
Domain – the right to use a specified internet domain name identified in an offer on the Website.
Buyer – a natural person, legal person or organisational unit purchasing a Domain.
Consumer – a natural person entering into a legal transaction with a trader that is not directly related to that person's business or professional activity.
Order – the Buyer's declaration intended to conclude an agreement concerning the acquisition of rights to a Domain.
Transfer – the technical and organisational steps that transfer control of a Domain to the Buyer, including in particular issuing an AuthInfo/AuthCode, changing the registrant, transferring to a designated registrar, an account push, or another appropriate procedure.
§3. Offers and Prices
Domains presented on the Website are offered for sale at the prices shown for the relevant Domain.
Prices in the Polish-language version are displayed in PLN.
Prices in the English-language version may be displayed and charged in USD.
The price displayed immediately before an Order is placed is the price applicable to that Order.
The Seller does not use automated individual price adjustments based on Buyer profiling.
If no price is stated for a Domain or purchasing has been disabled, an agreement cannot be concluded through the Website.
§4. Placing an Order
The Buyer selects a Domain and proceeds to the purchase process.
Before making payment, the Buyer receives information at least about:
- the Domain name,
- the price,
- the currency,
- how the Transfer will be carried out,
- the Seller's details,
- the applicable purchase terms.
Placing an Order that requires payment creates an obligation to pay the stated price.
The agreement is concluded after payment has been successfully completed and confirmed by the payment system, subject to the Domain remaining available.
Following a successful purchase, the Domain is marked as sold or reserved in accordance with the Website's mechanism.
§5. Payments
Electronic payments are processed by Stripe.
The Seller does not store Buyers' full payment card details.
The Buyer must provide accurate information required to process payment and fulfil the Order.
If a payment fails, is cancelled or expires, the Order may not be fulfilled and the Domain reservation may be released.
§6. Domain Transfer
The Seller begins the manual Domain Transfer process without undue delay after successful payment.
The Transfer is performed manually and may require the Buyer's cooperation.
The Buyer may be asked to provide information necessary for the Transfer, including in particular:
- registrant details,
- the account identifier at the registrar,
- registrar details,
- other information required by the registry operator or registrar.
The time required to complete the Transfer also depends on the procedures of the relevant registry or registrar and may be outside the Seller's control.
The Buyer must cooperate with the Seller to the extent necessary to complete the Transfer.
The agreement is deemed fully performed when control of the Domain has been successfully transferred to the Buyer under the applicable Transfer procedure.
§7. Consumers and the Right of Withdrawal
As a general rule, a Consumer entering into a distance agreement has a statutory right to withdraw from the agreement within 14 days, subject to exceptions provided by law.
Because the Seller begins the Domain Transfer without undue delay after purchase, a Consumer who requests performance of the Agreement to begin before the expiry of the statutory withdrawal period may be required to expressly request such early performance and acknowledge the legal consequences.
Where permitted by applicable consumer law, the right of withdrawal may cease after the Agreement has been fully performed with the Consumer's prior express consent and acknowledgement.
If a Consumer effectively withdraws after performance has begun but before it has been fully completed, the Consumer may be required to pay for the performance provided up to the time of withdrawal, to the extent permitted by applicable law.
Nothing in these Terms limits any mandatory consumer rights.
A withdrawal statement may be sent to: kmnowosielski@gmail.com
A Consumer may use the following model statement:
“I, [full name], hereby give notice that I withdraw from the agreement concerning the domain [domain name], concluded on [date]. Contact details: [details]. Date: [date].”
§8. Complaints
Complaints concerning the operation of the Website, payments or completion of a Transfer may be submitted to: kmnowosielski@gmail.com
A complaint should contain information allowing the Order to be identified and a description of the issue.
The Seller considers complaints without undue delay and in accordance with applicable law.
Consumer rights arising under mandatory provisions of law remain unaffected.
§9. Liability and the Nature of Domains
Before purchasing, the Buyer should independently assess whether the Domain is suitable for the intended purpose.
Purchasing a Domain does not confer rights to trademarks, business names, trade designations or other third-party rights.
The Seller does not guarantee that a Domain may be used in a particular industry if such use would infringe third-party rights.
The Buyer is responsible for how the Domain is used after the Transfer.
Marketing information, example industries, logos, visualisations and descriptions presented on the Website are for presentation purposes and do not constitute a legal guarantee that a particular brand or designation may be used.
§10. Website Intellectual Property
The graphic elements, text, Website layout, GodOfBrands logo and marketing materials may be protected by copyright or other rights.
Copying or distributing them beyond what is permitted by law requires the consent of the relevant rights holder.
§11. Personal Data
The rules governing the processing of personal data are set out in the Privacy Policy available on the Website.
Data necessary to fulfil an Order may be shared with entities involved in payment processing, hosting and the Domain Transfer.
§12. Final Provisions
Agreements concluded through the Website are governed by Polish law, subject to any mandatory Consumer rights arising under applicable law.
Matters not regulated by these Terms are governed by applicable law.
The Seller may amend these Terms for valid reasons, in particular due to changes in law, Website functionality or payment methods.
Changes to these Terms do not affect agreements concluded before the changes take effect.
The current version of these Terms is available on the Website.
